The terms and conditions apply to the use of the Raggedrose.com website. By placing an order with us, you are agreeing to accept these terms and conditions (The Conditions).
Please note, these terms and conditions can potentially change at any time, and it is up to you to check these terms and conditions regularly before ordering products in case there are any changes. If you do not agree with the terms and conditions set out below, you should not use or access these websites.

This Agreement contains the following provisions
1. General Information

Your contract for purchases made through raggedrose.com is with Ragged Rose Ltd and you undertake that all goods ordered by you are for your own private and domestic use only and are not for resale.
You must be eighteen years old or older to use this site. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.
You warrant that all details you provide to raggedrose.com for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.
You agree that e-mail can be used as a long-distance means of communication.
During the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from raggedrose.com under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If you think someone else might know it, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password. If there are any changes to the details supplied by you it is your responsibility to inform Ragged Rose Ltd as soon as possible.
It is a crime to use a false name or a known invalid credit card to order. Anyone caught deliberately entering an incorrect or fictitious order will be prosecuted to the fullest extent of the law. Ragged Rose Ltd tracks the electronic ‘fingerprints’ of every order placed on raggedrose.com to enable us, and all legitimate crime prevention and prosecution authorities, to trace individual users engaging in criminal activities on or using our website.
Ragged Rose Ltd reserve the right to end our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:

You may use the Website only if you have reached the age of majority where you live and you can form legally binding contracts under applicable law. You may not use the Website if you live in a jurisdiction where access to or use of the Website or any part of it may be illegal or prohibited. The Ragged Rose Ltd reserves the right to request proof of identification and age (for example, proof of your ability to purchase certain items).

The Ragged Rose Ltd may, in its sole discretion, change this Agreement from time to time as it relates to future use of the Website, by posting a revised Agreement on the Website. By using the Website after this revised Agreement has been posted, you signify your acceptance and agreement to be bound by the revised Agreement. You may not change this Agreement in any manner.
4. Ownership and permitted use of the website
The Website (including all content, page headers, custom graphics, button icons, and scripts and the presentation, arrangement, coordination, enhancement and selection of such and other information in text, graphical, video and audio forms, images, icons, software, designs, applications, data, and other elements available on or through the Website) is the property of The Ragged Rose Ltd and others, and is protected by British and international copyright, trademark and other laws. Your use of the Website does not transfer to you any ownership or other rights in the Website or its content. The Website is made available to you for your lawful, personal use only. You may use the Website only in the manner described expressly in this Agreement and subject to all applicable laws. Using the Website for any other purpose or in any other manner is strictly prohibited. You may print Website pages provided that you do not modify any of the pages and you do not remove or alter any visible or non-visible identification, marks, notices, or disclaimers. The Website and its content may not be copied, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, mirrored or distributed in any way, in whole or in part, without the express prior written consent of The Shop Owner. You may not sell or resell any part of the Website or access to the Website. You may not use any of the software that is used in the operation or provision of the Website except while you are using the Website in accordance with this Agreement.
5. Misprints and errors, product availability and prices
The Ragged Rose Ltd endeavors to provide current and accurate information on the Website. However, misprints, errors, inaccuracies, omissions (including incorrect specifications for products) or other errors may sometimes occur. The Ragged Rose Ltd cannot guarantee that products and services advertised on the Website will be available when ordered or thereafter. The Ragged Rose Ltd does not warrant that the content of the Website including, without limitation, product descriptions or photographs, is accurate or complete. The Ragged Rose Ltd reserves the right to: (a) correct any error, inaccuracy or omission at any time without prior notice or liability to you or any other person; (b) change at any time the products and services advertised or made available for sale on the Website, the prices, fees, charges and specifications of such products and services, any promotional offers and any other Website content without any notice or liability to you or any other person; (c) reject, correct, cancel or terminate any order, including accepted orders for any reason and (d) limit quantities available for sale or sold. The advertisements on the Website are invitations to you to make offers to purchase products and services on the Website and are not offers to sell.
6. No linking, framing, mirroring, scraping, data-mining or postings
Links to the Website without the express written permission of The Ragged Rose Ltd are strictly prohibited. To request permission to link to the Website, please send an email to The Ragged Rose Ltd via the contact page of this Website. The Ragged Rose Ltd may in its discretion cancel and revoke any permission it may give to link to the Website at any time and without any notice or liability. The framing, mirroring, scraping or data-mining of the Website or any of its content in any form and by any means is strictly prohibited. You may not use any collaborative browsing or display technologies in connection with your use of the Website or to post comments, communications, or any other data of any kind to or on the Website with the intention that such postings may be viewed by other users of the Website.
7. Login names and passwords
Certain areas and features of the Website are accessible only to users who have been issued a login name and password (collectively “User Details”) by The Ragged Rose Ltd. For the purposes of accessing the Website, the User Details remain the property of The Ragged Rose Ltd and may be cancelled or suspended at any time by The Ragged Rose Ltd in its discretion without any notice or liability to you or any other person. The Ragged Rose Ltd is not under any obligation to verify the actual identity or authority of any person using User Details to access and use the Website. The Ragged Rose Ltd may act upon any communication that is given with the use of User Details. The Ragged Rose Ltd may in its discretion at any time require proof of the identity of any person seeking to access and use the Website, and may deny access to and use of the Website or parts of it or refuse to accept or act upon any communication if The Ragged Rose Ltd is not satisfied with such proof. If you have been issued User Details: (a) you are fully responsible and liable for the security of the User Details and any and all use and misuse of the User Details; (b) you will keep the User Details secure and confidential at all times and not disclose the User Details to any other person or permit any other person to use the User Details; (c) you will ensure that all uses of the User Details comply with this Agreement; (d) once you have logged-on to the Website using the User Details, you will not leave the computer terminal used to access the Website unless and until you have terminated the session and logged-off the Website; and (e) you will immediately notify The Ragged Rose Ltd by telephone or email via the contact page of this Website if you know or suspect that any User Details have been lost or stolen or become known to or used by any other person.
8. Unsolicited submissions
In order to avoid potential misunderstandings or disputes, The Ragged Rose Ltd does not accept or consider unsolicited ideas or suggestions (“Submissions”). If you send Submissions to The Ragged Rose Ltd or the Website, you automatically grant (or warrant that the owner of the Submissions grants) to The Ragged Rose Ltd and its successors, assigns and licensees a perpetual, royalty-free, irrevocable, unrestricted, non-exclusive, world-wide, assignable, sublicensable, right and license to use and exploit the Submissions or any ideas, concepts, know-how or techniques associated with the Submissions for any purpose whatsoever, commercial or otherwise, using any form, media or technology now known or later developed, without providing any attribution or compensation to you or any other person, without any liability whatsoever, and free from any obligation of confidence or other duties on the part of The Ragged Rose Ltd or its successors, assigns and licensees, and you agree, represent and warrant that all moral rights in the Submissions are waived in favour of The Ragged Rose Ltd and its successors, assigns and licensees.
9. Your information
All information you provide through the Website, including registration information (name and email address), payment information (credit card numbers and expiration dates), and transaction-related information, must be true, accurate, current and complete. The Ragged Rose Ltd will rely on the information you provide. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, The Ragged Rose Ltd or any other person may incur as a result of your submission of any false, incorrect or incomplete information or your failure to update your registration information and payment information within 30 days of any change.
10. Disclaimers, liability exclusions/ limitations and indemnity
DISCLAIMERS YOUR ACCESS TO AND USE OF THE WEBSITE IS AT YOUR OWN RISK. THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AND INCLUDING WITHOUT LIMITATION IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF OR RELATING TO ACCURACY, ACCESSIBILITY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, PERFORMANCE OR DURABILITY, ALL OF WHICH ARE DISCLAIMED BY THE SHOP OWNER TO THE FULLEST EXTENT PERMITTED BY LAW. ACKNOWLEDGEMENT AND EXCLUSION BY STATUTE IN CERTAIN JURISDICTIONS THE EXCLUSION OF CERTAIN WARRANTIES AND THE LIMITATION OF CERTAIN LIABILITIES IS PROHIBITED IN SOME JURISDICTIONS. THESE STATUTORY PROHIBITIONS MAY APPLY TO YOU.
11. Personal information privacy
Notwithstanding any other provision of this Agreement, The Ragged Rose Ltd may in its discretion change, discontinue, modify, restrict, suspend or terminate the Website or any part of it without any notice or liability to you or any other person. The Ragged Rose Ltd may in its discretion and for its convenience at any time immediately terminate, temporarily or permanently, this Agreement or your permission to access and use the Website without any notice or liability to you or any other person. If this Agreement or your permission to access or use all or any part of the Website is terminated for any reason, then this Agreement and all other then existing agreements between you and The Ragged Rose Ltd will continue to apply and be binding upon you regarding your prior access to and use of the Website, and anything connected with, relating to or arising therefrom.
13. Governing law and dispute resolution
This Agreement, your access to and use of the Website, and all related matters are governed solely by the laws of the United Kingdom. Any dispute between you and The Shop Owner or any other person arising from, connected with or relating to the Website, this Agreement, or any related matters (collectively “Disputes”) will be resolved before the British Court, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of this court in respect of all Disputes.
14. Your responsibilities if you break these Conditions
You agree that if you break these Conditions, or any liabilities are incurred arising out of your use of this website, you will be responsible for the costs and expenses that we or our officers, directors, employees, agents and suppliers incur as a result of the breach, including reasonable legal fees (if applicable). You will remain liable if someone else uses your shopping account and/or personal information unless you can prove that such use was fraudulent.
When placing an order, you agree that any and all information given is accurate and complete.
All orders are subject to acceptance and product availability.
Availability information for products is listed on each individual product description. If raggedrose.com does not have enough stock to deliver the goods you have ordered, we will not charge your credit or debit card until the items are back in stock and ready to be despatched.
All prices listed on raggedrose.com are correct at the time of entering the information, however, we reserve the right to change prices of any product at any time. All prices include sales tax
No contract for the sale of any product will exist between you and raggedrose.com until we accept your order by dispatching the product to you. When this happens we will confirm the acceptance by sending you an email
This confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost (including VAT and P&P) and usual delivery times.
You must check all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect.
If your order has not been accepted, you will receive an email from us telling you the reasons why.
Discount vouchers, codes and offers cannot be used on sale products.
16. Delivery Within the UK
Standard delivery 3-5 working days items:
Free standard delivery on order value over £50
Express delivery order by 2pm dispatch same day for next day delivery. Up to 10kg – £9.95 (exclude Saturday and Sunday).
International deliveries please allow up to 14 days please ask for quotes.
The delivery period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock.
If your delivery address is outside of the UK, you may have to pay import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance. Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information.
Please note international shipments may be subject to cross-border inspections by customs authorities.
17. Raggedrose.com accept most major credit/debit cards:
All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
18. Cancelling an Order/Returns Procedure
If you haven’t submitted an order, you may clear the items in your shopping basket at any time by clicking the ‘Remove’ button next to the product you do not wish to purchase in your shopping basket.
If you have placed an order but then wish to change or cancel it, please contact us as soon as you can, in writing or e-mail within 7 working days as orders move rapidly through to our warehouse. We will try our best to make any changes but we cannot guarantee that we will be able to do so as the order may already have been processed. In such cases, you may have to wait until you receive the order and then follow the normal Returns procedures. You must take reasonable care of the goods and not use them. Please return goods in their original packaging. If you return goods to us, we will not be responsible for any loss or damage to them during the transit, so we recommend a recorded or secure delivery.
Once we’ve heard from you that you wish to cancel an order, any sum debited to us from your credit or debit card will be re-credited to that credit or debit account within 30 days of your order, provided the goods you return are in the same condition that they were when delivered to you. You will be liable to any charges incurred when returning the goods to raggedrose.com, unless the return is as a result of an error on our side.
If you are in the European Union and you cancel your order within seven days after the day you get your goods, and you cancel the whole order, we will refund the standard postage and packing costs you paid as part of that order (if any), in accordance with the Distance Selling Regulations. If you paid for premium or express delivery, we will only refund the cost of standard delivery. You will have to pay the costs of sending the order back to us. We will not refund any postage and packing charges if you cancel after the seven days allowed under the Distance Selling Regulations or if you only cancel part of your order (although you still have three months to return your goods and receive a refund for the cost of the goods).
19. Contract cancellation
You can cancel this contract if you so wish, provided that you exercise your right to do so within seven working days after the day on which you receive the products.
If you wish to cancel your order, please follow the procedure set out in our Returns procedure.
20. Returns Procedure
You may fill the Returns Form and return most items sold by raggedrose.com within 28 days from the date of despatch for a full refund as long as goods are unused and returned in original condition. For more information, please refer to our Returns procedure.
You must ensure that the goods are returned clean,unused and in their original packaging with all swing tags /barcodes. Otherwise we will have to charge a re-stocking fee of £2.50 per item to cover warehouse man power cost of re bagging, re ticketing and barcoding.
Please note that our fabric’s are non returnable as they are cut to length. If you are unsure of the colour we are happy to send out a swatch — just send us an email on firstname.lastname@example.org with your name and address. We are happy to oblige.
If an item is recieved and deemed to be faulty,please contact us by phone or email as soon as possible.We request photos of the product so we can ascertain the issue and then we will arrange to send a returns envelope.
Special order items which include goods that have been altered or custom made to a specific colour,style or size and not normally sold on our website must be paid in full before commencement of work and are non-returnable unless faulty .
21. Exchange Procedure
Raggedrose.com will be happy to exchange for the same item most products that are damaged, faulty or incorrectly shipped through any circumstance that is in our error within 3 months from the date of despatch. For more information, please refer to our exchange procedure
Raggedrose.com will not pass on your personal, credit or debit card details to any third party.
We will never ask for personal details via email. If you receive an unsolicited email asking you for your raggedrose.com log in details, please contact our Customer Service team immediately.
Ragged Rose only collects information for the purposes of fulfilling requested orders or transactions as well as the monthly newsletter. If you wish to have your information removed please contact our Customer Service team and all relevant information will be deleted, respecting the right to be forgotten.
We do not accept liability (except as set out below) for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on raggedrose.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the subject product. You may re-order it if you wish. If you have already paid for the goods in the circumstances described in this clause, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation email within 10 working days of delivery of the goods plus return the goods to us, unless we inform you that return is not necessary. This provision does not affect your statutory rights.
We have taken every measure to provide accurate product images for each product for sale on the site. However, due to a number of different factors such as Internet browsers, monitor colour contrasts etc, we cannot be held responsible or liable for any differences in colour between the image and the actual product.
The products sold on raggedrose.com are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from raggedrose.com
We have taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.
We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:
Any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
Any loss of goodwill or reputation; or
Any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.
Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.
All rights, including copyright, in the content of the raggedrose.com web pages are owned or controlled by Ragged Rose Ltd. In accessing raggedrose.com web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of the raggedrose.com web pages for any other purpose whatsoever without the prior written permission of Ragged Rose Ltd.
25. Third Party Information
We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for Ragged Rose Ltd products are those stated on the Ragged Rose material. We cannot vouch for the reliability of prices stated on shopping directories or through any other third party.
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.
28. Entire agreement
These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Ragged Rose and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation except where that representation has been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
Any rights not expressly granted by this Agreement are reserved to The Ragged Rose Ltd. You may contact The Ragged Rose Ltd by telephone, email, or postal mail via the contact page of this Website.
